1. Acceptance


These Terms & Conditions (“Terms”) govern your use of https://imperialkitchen.in (the “Website”) and any reservation, enquiry or booking you make through it. By using the Website you agree to these Terms. If you do not agree, please do not use the Website.

The Website is operated by Imperial Kitchen, trading as Imperial Kitchen, [REGISTERED ADDRESS].

 

 

2. Eligibility

 

You must be 18 years or older to make a reservation or banquet booking, or to submit information through the Website. Bookings made by minors are void. Where the law of Kerala applies, the legal drinking age is 23 years, and alcohol is served only at licensed branches, only during licensed hours, and only against valid government photo ID.

 

 

3. Use of the Website

 

You agree not to:

  • use the Website for any unlawful purpose or in breach of any applicable law

  • make false, speculative, duplicate or fraudulent reservations

  • attempt to gain unauthorised access to the Website, its servers or any connected system

  • introduce malware, scrape content in bulk, or use automated tools to place bookings

  • post content that is defamatory, obscene, hateful, infringing or otherwise unlawful

  • impersonate any person or misrepresent your affiliation with anyone

We may suspend or refuse service to anyone who breaches these Terms.

 

 

4. Table reservations

 

  • Reservations are requests until confirmed by us. We confirm by WhatsApp, SMS or call to the number you provide, so please give an accurate, reachable number.

  • No card details and no deposit are required for standard table reservations.

  • We hold reserved tables for [15] minutes past the booked time. After that the table may be released to waiting guests.

  • Table assignment is at our discretion; requests for a specific table, section or view are noted but not guaranteed.

  • Significant changes to your party size may not be accommodated. Please inform us in advance.

  • To cancel or change a booking, contact the branch on the numbers listed on the Website.

  • Repeated no-shows may result in us declining future reservations.

  • Weekend dinner and banquet bookings should be made at least 24 hours in advance.

  • We reserve the right of admission, and may refuse or discontinue service in cases of intoxication, unsafe or abusive behaviour, or breach of house rules.

 

 

5. Banquet halls and events

 

Bookings for Starlite (Kowdiar) and Moonlite (Venpalavattom) are subject to a separate written event agreement, which prevails over these Terms in the event of conflict. Unless otherwise agreed in writing:

  • An advance of [XX]% is payable to confirm the date; the balance is payable [on/before the event date].

  • Cancellation charges apply on a sliding scale: [e.g. more than 30 days — advance refunded less ₹X; 15–30 days — 50% of advance retained; under 15 days — advance non-refundable].

  • A guaranteed minimum guest count must be confirmed [7] days in advance and is chargeable even if fewer guests attend. Additional guests are charged at the agreed per-head rate.

  • Menu selections are to be finalised [7] days in advance. Late changes are subject to availability.

  • Outside food and beverage, including alcohol, is not permitted unless expressly agreed in writing.

  • Décor, entertainment, fireworks and external vendors require prior written approval and must comply with fire, safety, noise and licensing regulations.

  • The client is responsible for the conduct of their guests and for the cost of any damage to the premises, fittings or equipment.

  • Hall timings, sound limits and licensing hours as notified by local authorities apply strictly.

  • We are not responsible for loss of or damage to gifts, valuables or personal belongings left at the venue.

 

 

6. Menu, pricing and taxes

 

  • Menu items, prices, images and descriptions on the Website are indicative and are subject to change without notice. Photographs are for representation only; actual presentation may vary.

  • The price charged is the price displayed at the branch at the time of your visit.

  • Dish availability depends on seasonality and daily stock, and varies between branches.

  • All prices are exclusive of applicable GST unless stated otherwise. Taxes are charged at prevailing rates.

  • Any service charge is voluntary, is separately disclosed on the bill, and may be removed at your request in line with the guidelines of the Central Consumer Protection Authority.

  • Branch timings, including late-night hours at Kowdiar, are subject to licensing and may change.

 

 

7. Food allergies, dietary requirements and health

 

Our kitchens handle nuts, dairy, gluten, eggs, shellfish, seafood and other common allergens, and prepare vegetarian and non-vegetarian food in a shared environment. We cannot guarantee that any dish is entirely free from a given allergen or from cross-contact.

Please inform your server of any allergy, intolerance or dietary or religious requirement before ordering. Nutritional and ingredient details given on the Website or verbally are indicative only. Guests with severe allergies dine at their own discretion.

 

 

8. Payments

 

Payments are made at the branch or as set out in your event agreement. We accept [cash, UPI, credit/debit cards, and other modes as displayed]. The Website does not process payments. Where any online payment facility is introduced, it will be operated through a licensed payment gateway and governed by additional terms.

 

 

9. Offers, vouchers and promotions

 

Offers, discounts, loyalty benefits and gift vouchers are subject to their own terms, validity periods and branch-specific conditions, cannot be combined unless expressly stated, are non-transferable and non-encashable, and may be withdrawn or modified at any time.

 

 

10. Intellectual property

 

All content on the Website — including the Imperial Kitchen name and logo, text, menus, photographs, videos, graphics, layout, and the Moments gallery — is owned by us or our licensors and is protected under the Copyright Act, 1957 and the Trade Marks Act, 1999.

You may view and print content for personal, non-commercial use. You may not reproduce, republish, distribute, modify, or use our content or marks for commercial purposes, or in a way that suggests endorsement or affiliation, without our prior written permission.

 

 

11. Your content

 

If you post a comment, review, testimonial, photograph or other content on the Website or tag us on social media, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce and display that content in connection with promoting Imperial Kitchen, with attribution where practicable. You confirm you own the content or have the right to share it. We may moderate, edit or remove content at our discretion, and are not obliged to publish anything.

 

 

12. Third-party links and delivery partners

 

The Website links to third-party services including WhatsApp, Google Maps and social media platforms, and our food may be available through delivery aggregators. Those services operate under their own terms, pricing and delivery policies. We are not responsible for their content, availability, service quality or acts and omissions.

 

 

13. Disclaimers

 

The Website is provided on an “as is” and “as available” basis. While we take care to keep information accurate and current, we make no warranty that the Website will be uninterrupted, error-free, secure, or that menus, prices, timings or availability shown are complete and up to date at all times. To the maximum extent permitted by law, all implied warranties are excluded.

 

 

14. Limitation of liability

 

To the maximum extent permitted by applicable law, Imperial Kitchen, its partners, directors, employees and agents will not be liable for any indirect, incidental, special or consequential loss, or for loss of profit, opportunity, data or goodwill, arising from your use of the Website or from a reservation made through it.

Where liability cannot be excluded, our total aggregate liability in connection with the Website or a table reservation is limited to ₹[5,000] or the amount you actually paid to us in respect of the relevant transaction, whichever is lower. Liability in respect of banquet events is governed by the event agreement.

Nothing in these Terms excludes liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot lawfully be excluded under the Consumer Protection Act, 2019 or other applicable law.

 

 

15. Indemnity

 

You agree to indemnify and hold us harmless against any claim, loss, liability or expense (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Website, or content you submit.

 

 

16. Force majeure

 

We are not liable for failure or delay in performance caused by events beyond our reasonable control, including natural disasters, floods, epidemics or pandemics, fire, strikes, civil unrest, hartals, government orders, licensing restrictions, power or internet failure, or supply chain disruption. In such cases we will endeavour to reschedule bookings or refund advances on a reasonable basis.

 

 

17. Privacy

 

Your use of the Website is also governed by our [Privacy Policy](https://imperialkitchen.in/privacy-policy/), which forms part of these Terms.

 

 

18. Changes to these Terms

 

We may revise these Terms at any time. The updated version applies from the date it is posted on this page. Continued use of the Website after that constitutes acceptance.

 

 

19. Governing law and jurisdiction

 

These Terms are governed by the laws of India. Subject to any applicable consumer protection law that gives you the right to approach a forum at your place of residence, the courts and tribunals at Thiruvananthapuram, Kerala have exclusive jurisdiction over any dispute arising out of these Terms.

 

 

20. General

 

If any provision of these Terms is held invalid or unenforceable, the remaining provisions continue in full force. Our failure to enforce any provision is not a waiver of it. These Terms, together with the Privacy Policy and any event agreement, form the entire agreement between you and us regarding the Website.
